These Terms and Conditions govern your use of services provided by Acquire Systems (ABN 16 696 808 947) ("we", "us", "our"). By engaging our services or using our platform, you agree to these terms in full.
Please read these terms carefully. If you do not agree, you should not use our services.
Acquire Systems provides marketing automation software and services for small businesses and tradespeople, including but not limited to:
Services are delivered primarily through our platform partner GoHighLevel (GHL). Service inclusions may change from time to time and we will notify you of any material changes.
Services are billed monthly in advance. All prices are in Australian Dollars (AUD) and exclude GST unless otherwise stated. GST will be added to all invoices at the current rate.
A one-off setup fee is charged at commencement of services. This fee covers initial configuration, website build, and onboarding. Setup fees are non-refundable once work has commenced.
Payment is due on the date of each invoice. We accept payment by credit card and direct debit. Late payments may result in suspension of services.
We reserve the right to change our pricing with 30 days written notice. Continued use of the service after the notice period constitutes acceptance of the new pricing.
You may cancel your subscription at any time with no lock-in penalty. Cancellation takes effect at the end of the current billing period. No refunds are provided for unused portions of a billing period.

We guarantee that if our system does not win you at least one additional job per month, we will work with you at no additional cost until it does. This guarantee is subject to:
The guarantee does not apply where poor results are attributable to factors outside our control, including market conditions, the quality of your work, or your responsiveness to leads.
You agree to:
All content, software, designs and materials we create for you as part of our services remain the property of Acquire Systems until full payment is received, at which point ownership of your specific website content transfers to you.
Our platform software, templates, and automation systems remain our intellectual property at all times.
To the maximum extent permitted by Australian law, Acquire Systems will not be liable for any indirect, incidental, special or consequential loss or damage arising from your use of our services.
Our total liability to you for any claim arising from these terms or our services will not exceed the total fees paid by you in the three months preceding the claim.
Nothing in these terms excludes or limits rights you may have under the Australian Consumer Law that cannot be excluded or limited.
Our services rely on third-party platforms including GoHighLevel, Google, Meta, and others. We are not responsible for the availability, accuracy or actions of these third-party services. Downtime or changes to third-party platforms may affect our services and we will make reasonable efforts to address any such impact.
These terms are governed by the laws of Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Australia.
